The Right to Manage (RTM) was introduced by the Commonhold and Leasehold Reform Act 2002. It gives leaseholders of flats the legal right to take over the management of their building without having to prove fault on the part of the existing managing agent or freeholder.
An RTM company can be formed by a qualifying group of leaseholders. Once established, it takes over the management functions — including service charge collection, maintenance, building safety, and insurance — directly from the freeholder or existing management company.
Unlike collective enfranchisement, you do not need to buy the freehold. The freeholder retains ownership, but you gain control over day-to-day management and service charge expenditure.

You must be a leaseholder of a flat in the building with a lease granted for a term of more than 21 years.
At least half of the qualifying leaseholders in the building must join the RTM company. Those who do not wish to participate are still entitled to membership.
Buildings where the freeholder or a third party occupies commercial premises exceeding 25% of the total floor area are excluded from the RTM process.

We serve a formal notice of claim on the freeholder and any other parties named in the lease. The freeholder has one month to respond and may serve a counter-notice.
If no counter-notice is served, or if the grounds are not valid, the RTM company acquires the right to manage on the acquisition date — typically four months after the notice was given.
